1. Scope of application
By placing an order with the company Pillon Diffusion with its registered address in Ch. De Pierrefleur 54, 1004 Lausanne, editor of the site www.lachemise.ch, the customer shall be deemed to have accepted the present General Terms and Conditions of Sale, in their entirety and without exception. Pillon Diffusion reserves the right to make changes to the present General Terms and Conditions of Sale at any time. The original language of the present General Terms and Conditions of Sale is French. In the case of differences between the French text and the translation into other languages, only the French version shall be held binding.
2. Delivery territory
The delivery territory is limited to the Helvetian Confederation.
The order is sent to the delivery address that is indicated at the moment the shopping cart is validated.
3. Items
The description of the items offered for sale on the site www.lachemise.ch as well as the photos that are illustrating them are provided for information purposes only and do not bind the company Pillon Diffusion in any way. The indicated prices are valid for the current visit only. Pillon Diffusion reserves the right to make changes without prior notice.
4. Prices
All prices quoted are net prices in Swiss Francs (CHF), including VAT, at rates in force, and excluding postage and packaging charges. The prices quoted on the confirmation shall be held binding, and this also in case of an increase between order date and delivery date of the aforesaid order.
5. Conclusion of the sale
All orders shall be deemed firm and final. The sale is concluded from the moment that the customer’s shopping cart is validated and a confirmation is sent by email. An order placed by the customer by phone, by fax or by email shall be deemed valid from the moment of receipt of a confirmation by post or email. From the moment of receipt of the confirmation, the customer can no longer modify or cancel his order. Pillon Diffusion reserves the right to refuse an order without disclosing a reason.
6. Payment
The payment is effectuated at the moment of the order. The customer has the choice of payment by:
PostFinance,
Credit card on our secure site (Visa, Mastercard)
Payment cash on delivery.
7. Security
We use the services of Datatrans specializes in online shop payment operations performing the highest transaction security for all credit cards. This company has been choosen by some of the biggest nationals companies (Swisscom, Orange, Le shop.ch) that is for us the most important credit for the security.
No payment data is stored on the site www.lachemise.ch
8. Delivery term
Except for special terms specified at the moment of validation of the order, the delivery term is in general 3/4 working days after the confirmation.
9. Responsibility of the customer
The goods travel under the responsibility of the customer who may subscribe, if desired, to complementary services (insurance or personal handover of consignment to the recipient) when placing the order that will be subject to manual processing. The complementary services will be invoiced to the customer. In the case of a damaged parcel, it is up to the customer to make a complaint to the carrier and to inform Pillon Diffusion within 48h by fax on +41 (0)21 311 39 00 or by email to: direction@lachemise.ch.
10. Right to return
Goods delivered in error or in a higher number than ordered must be returned immediately, at the latest within 7 working days from the moment of the date of receipt. The goods must be returned undamaged, unopened and in their original packaging. The customer has the possibility to ask Pillon Diffusion for a return free of charge. In the case of non return, the goods will be considered accepted and invoiced.
11. Claim, reimbursement
If the goods are defective, Pillon Diffusion guarantees immediate replacement to the limit of available stock. Any claim must be transmitted within 7 working days following the receipt of the goods, the information can be sent by fax +41 (0)21 311 39 00 or by email at direction@lachemise.ch. The goods that cannot be replaced will be reimbursed at the price paid and credited to the credit card used for payment or the customer account.
12. Postage and packaging fees
The consignments are delivered by Swiss Post as “Signature PostPac Economy”. The postage and packing fees are detailed on the order confirmation and added to the indicated prices on the order form and invoice. On invoices for express orders a surcharge will be levied. If Swiss Post is unable to deliver the package, they will leave an attempted delivery note in the mailbox. The package will be available at the post office for the next 7 working days. The customer can ask the post office to redeliver. This service is the responsibility of the service provider. Pillon Diffusion can not be held responsible for a delivery problem after remittance of the package to the service provider.
13. Invoicing
Each delivery is accompanied by a paid invoice that states the payment method.

15. Other cases
The Swiss Code of Obligations will apply for all cases not regulated by the present General Terms and Conditions of Sale.
16. Data protection
Pillon Diffusion undertakes to respect the provisions of the Federal Law on data protection. All personal data provided by the customer is treated confidentially and exclusively used for the commercial transaction between the customer and Pillon Diffusion.
Pillon Diffusion informs the customer of new products, promotions and other services. The customer has the right to modify, rectify or delete any personal data that he has provided. To exercise his right, he can contact the customer service of Pillon Diffusion.
17. Validity of the contract
If any provision of the present General Terms and Conditions of Sale shall be held void or unenforceable for any reason whatsoever (legal, regulatory or following a judicial decision), it shall not affect the validity of the remaining provisions.
18. Legal venue
The legal venue is Lausanne. The Swiss Law is applicable in the relations between the parties.
